A Deck That Fits the Space
The homeowners at 264 Sidney Street wanted to replace their existing deck with a new one to enhance their lifestyle and upgrade their property. However, the proposed deck landing extended into the rear yard setback established by the Cambridge Zoning Ordinance.
Turning Setbacks Into Progress
As outlined in the Cambridge Zoning Ordinance, the required rear yard setback of the land parcel lot is 20 feet. The proposed landing, approximately 11.7 feet from the rear property line, maintained the same footprint as the existing deck without further encroachment. However, the nonconforming size of the lot required a special permit to proceed with construction.
Navigating Zoning Challenges
Navigating zoning laws, especially when a property is nonconforming, can take time and effort. In Cambridge and across New England, any new projects must adhere to strict regulations. Exceptions require thorough analysis and a professional presentation to the Board of Zoning Appeal.

Platinum Partners collaborated with the homeowners and worked closely with MBL Land Development & Permitting, Corp. to ensure a seamless process. While MBL prepared detailed site plans, our team conducted a comprehensive regulatory analysis to build a strong case for the special permit request.
A Winning Outcome at the Zoning Board
We presented our findings and the case to the Cambridge Board of Zoning Appeals, drawing attention to the fact the proposed deck would match the dimensions of the existing porch, causing no adverse impact on the neighborhood.
After careful consideration, the BZA approved the special permit, allowing the homeowners to move forward with their new deck.
This approval removed the biggest obstacle our client faced in their project. The favorable decision reinforced the importance of planning and expert guidance in securing building permits and zoning approvals before beginning work.
